1. Acceptance of Terms

By accessing and using GoAIgentic's AI Growth Engine platform ("Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Service Description

GoAIgentic provides an AI-powered growth platform designed for mid-size medical practices. Our Service includes patient acquisition automation, operations optimization, revenue intelligence, and related healthcare practice management tools.

3. Account Registration

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be authorized to represent and bind your medical practice
  • Comply with all applicable healthcare regulations

4. Acceptable Use

You agree to use the Service only for lawful purposes. You will not:

  • Violate any laws or regulations, including HIPAA
  • Infringe on intellectual property rights
  • Transmit malicious code or attempt to breach security
  • Use the Service to harm, harass, or deceive others
  • Reverse engineer or copy any part of the platform

5. Data and Privacy

Your use of the Service is subject to our Privacy Policy and HIPAA Business Associate Agreement. You retain ownership of your data, and we process it only as necessary to provide the Service and as authorized by you.

6. Fees and Payment

Service fees are as stated in your subscription plan. Fees are billed monthly or annually in advance. You authorize us to charge your payment method on file. We may modify pricing with 30 days' notice.

7. Cancellation and Termination

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We may suspend or terminate your account for violations of these Terms. Upon termination, you will have 30 days to export your data.

8. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION. WE ARE NOT LIABLE FOR ANY MEDICAL DECISIONS MADE USING THE SERVICE. THE SERVICE IS A PRACTICE MANAGEMENT TOOL, NOT A MEDICAL DEVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOAIGENTIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold GoAIgentic harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of others.

11. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance of modified Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
